Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the NexaTechNG website, onboarding application, training programmes, and related platform services. By using our services or submitting an application, you agree to these Terms and our Privacy Policy.

1. About NexaTechNG

NexaTechNG (“we”, “us”) operates a global platform for:

• Data & annotation work — image labeling, text classification, transcription, RLHF, content moderation, and related tasks.
• Software engineering services — code review, technical QA, and contract development for clients.
• Training & onboarding — free assessment, bootcamp, and calibration before paid production work.

Client-facing commercial services may also be offered via products.nexatechng.com, which may have separate terms.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your country, if higher), legally able to enter agreements, and provide accurate information. You are responsible for maintaining the confidentiality of verification codes sent to your email.

3. Application & onboarding

• Applying is free. We do not charge application fees.
• You must provide truthful, complete information. False or misleading applications may be rejected or terminated.
• Email verification is required before submitting your profile.
• Selection for bootcamp, projects, or paid queues is at our sole discretion based on skills, quality, capacity, and client need.
• Submitting an application does not guarantee employment, contractor engagement, or any minimum hours or income.

4. Consent to profile reuse

By checking the profile reuse consent box during onboarding, you expressly agree that NexaTechNG may:

• Store your application, CV, skills, experience level, and related data in our talent database.
• Use that information to evaluate and match you to current and future job listings, bootcamps, project queues, and assignments on the platform.
• Consider you for roles outside your initially selected track (SWE or Data) where your profile qualifies.
• Contact you by email regarding opportunities aligned with your profile.

You may withdraw this consent for future matching by contacting onboarding@nexatechng.com. Withdrawal does not affect prior lawful use or active engagements.

5. Training & work

• Free training modules are provided for skill development and calibration; completion does not guarantee paid work.
• Paid tasks, rates, and schedules depend on project availability, your performance, and separate work agreements where applicable.
• You agree to follow project guidelines, quality standards, confidentiality rules, and client instructions for any assigned work.
• Contributors must maintain reliable internet, appropriate workspace, and professional conduct.

6. Intellectual property

• Our website, branding, training materials, and platform content remain our property or our licensors’.
• Work product created during paid client projects is governed by applicable client/work agreements; you must not reuse confidential client data or deliverables outside authorised scope.
• You retain ownership of pre-existing materials you disclose (e.g. portfolio, open-source); you grant us a licence to use application materials for recruitment and matching as described in these Terms and the Privacy Policy.

7. Acceptable use

You agree not to:

• Submit false credentials, impersonate others, or create duplicate accounts to circumvent review.
• Attempt unauthorised access to our systems, APIs, or other users’ data.
• Upload malware, unlawful content, or files you do not have rights to share.
• Scrape, harvest, or automate access in violation of robots.txt or these Terms.
• Use the platform for any unlawful purpose.

8. Disclaimers

AS IS. The website and onboarding tools are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

• We do not warrant that you will be selected, trained, or assigned paid work.
• Remote work availability varies by region, project, and client demand.
• We are not liable for third-party platforms (GitHub, email providers, payment processors) outside our reasonable control.
• Nothing in these Terms creates an employment relationship; contributors are generally engaged as independent contractors unless a separate written agreement states otherwise.

9. Limitation of liability

To the maximum extent permitted by law, NexaTechNG and its officers, directors, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the services. Our total liability for any claim relating to the website or application process shall not exceed USD $100 or the amount you paid us in the twelve months preceding the claim (typically zero for applicants).

10. Indemnification

You agree to indemnify and hold NexaTechNG harmless from claims arising from your breach of these Terms, inaccurate application information, or misuse of the platform.

11. Termination

We may suspend or reject applications, remove profiles, or terminate access for violation of these Terms, fraud, quality issues, or inactivity. You may request deletion of your application data subject to our Privacy Policy and legal retention requirements.

12. Governing law & disputes

These Terms are governed by applicable laws in the jurisdiction where NexaTechNG primarily operates, without regard to conflict-of-law principles. Disputes should first be raised with info@nexatechng.com. Where permitted, disputes may be resolved through good-faith negotiation before formal proceedings.

13. Changes

We may modify these Terms at any time. Continued use after the updated date constitutes acceptance. Material changes to consent-related terms may require renewed acceptance for new processing.
